GHS obligatory in South Africa

South African companies have been able to use GHS compliant requirements voluntarily since 2012. New adopted regulations now make the requirements obligatory.

As from September 2022 manufacturers, importers, suppliers and retailers of hazardous chemical substances and mixtures that are intended to be used at a workplace must comply with the requirements on classification, labelling, packaging and safety data sheets as laid down in the Regulations for Hazardous Chemical Agents, 2021 that implement GHS rev 8 of 2019.

The legal text indicates that the Regulations will be regularly updated to adapt to the latest revision of GHS.

Companies have been able to use GHS compliant classifications and safety data sheets on a voluntary basis since 2012 through the South African National Standard (SANS) 10234. The Regulations for Hazardous Chemical Agents, 2021 now make such requirements obligatory.

The Regulations also cover other health and safety aspects when working with hazardous chemicals, such as air monitoring, medical surveillance and disposal. The related requirements are already in force.
