Hand disinfectants with active chlorine now legal

According to an interpretation of the EU’s Biocidal Products Regulation, article 89, subsection 2, hand disinfectants based on active chlorine can be marketed and used in the EU if certain conditions are met.

The following three conditions must be met before a biocidal product/product family with active chlorine can be approved for sale or use under product type 1 (PT1):

  1. The hand disinfectant must be based on either active chlorine released from hypochlorous acid or active chlorine generated by electrolysis of sodium chloride
  2. The applicant must have applied for approval of the disinfectant according to the Biocidal Products Regulation (BPR) in PT1 and for one or more other product types in product type 2, 3, 4 or 5
  3. The hand disinfectant must comply with the rules concerning sale of biocidal products under the EU transitional scheme 

If you have only applied for approval under the BPR for a biocidal product (or product family) for product type 1, the above does not apply. In that case, a final approval of the product is required before it can be sold or used in the EU.
