New EU regulation for recycled plastics for food contact enters into force

With certain exceptions, only recycled plastic containing plastic from a suitable recycling technology may be marketed after July 2023.

Other changes in the new regulation include specific rules for collecting, sorting and decontamination of recycled plastics, as well as provisions for documentation, labelling and quality control. 

The regulation comes into force in October 2022 and replaces Regulation No. 282/2008, which is repealed.

Important cut-off dates for PET recycling technologies
It is the European Commission that approves technologies for plastic recycling. When it comes to new technologies for polyethylene terephthalate (PET), you should be aware of the following dates:

  • If you have applied for approval of a recycling technology before July 2023, you can continue to market the recycled plastic after July 2023 until you receive a decision on the authorisation.
  • If you apply for approval of a recycling technology after July 2023, you must obtain authorisation before the technology may be used.

In October 2024, it will be a requirement that all quality assurance systems used to collect and pre-process plastics for recycling must be certified by a third party.

Applicable also to imported recycled plastic
The above rules apply to all plastic placed on the EU market, including recycled plastic from recycling installations located outside of the EU.
