ECHA has initiated a public consultation on derogation to the exclusion criteria for the biocide active substance DBNPA. Deadline for providing information is 10 December 2019.

This summer ECHA’s Biocidal Products Committee concluded that DBNPA (2,2-dibromo-3-nitrilopropionamide) should not be approved for product-type 4 (food and feed area) due to the endocrine disrupting properties of the chemical. This was the first decision of rejection based on the new criteria for identifying endocrine disruptors in biocides.

Derogations may be possible, as laid down in the articles of the EU Biocides Products Regulation, for a maximum period of five years and for restricted uses.

ECHA asks interested parties to participate in the public consultation on DBNPA for product-type 4. Submitters should be aware that for a consultation on the same active substance for several product-types, separate submissions for each product-type must be provided, as the derogation to exclusion is analysed product-type per product-type and use per use within the product-type.
